IBM Software Patent Spat Moves From Texas To Neb.

Law360 (June 10, 2009, 12:00 AM EDT) -- IBM Corp. has won a dismissal in a fight over a software patent, but adversary Automated Facilities Management Corp. has muted the effect by taking up the dispute in another venue.

Judge T. John Ward of the U.S. District Court for the Eastern District of Texas dismissed on Wednesday AFMC's infringement suit over a patent that covers building management software. IBM filed a motion May 1 saying AFMC does not own the patent-in-suit and has no standing to sue.
