Dey Joins In Spoliation Cries In Drug Price MDL

Law360, New York (June 15, 2009, 12:00 AM EDT) -- Dey Inc. has joined Abbott Laboratories in pursuit of sanctions against the U.S. Department of Justice over alleged spoliation of evidence in multidistrict antitrust litigation accusing the pharmaceutical industry of a conspiracy to artificially boost wholesale drug prices.

In a motion filed Friday in the U.S. District Court for the District of Massachusetts, Dey alleges that the department did not implement a document hold as it spent nine years conducting discovery related to the qui tam suit that prompted the investigation.
