Fla. High Court Will Review Jury Fiasco In $3M Tobacco Case

Law360 (July 18, 2018, 9:52 PM EDT) -- The Florida Supreme Court said Wednesday that it will review a decision ordering a new trial in a smoker’s case against tobacco companies that resulted in a $3 million award because the tobacco companies were unable to sufficiently question potential jurors.

The high court said it would accept jurisdiction and determine whether the trial court erred in denying the defense the opportunity to question 31 members of the jury pool before excusing them for bias.

Post-verdict, the trial court reversed itself and ordered a new trial, which was later affirmed by a state appeals court.
