Supreme Court Won't Hear FCC Franchise Rule Appeal

Law360, New York (June 15, 2009, 12:00 AM EDT) -- The U.S. Supreme Court has refused to hear a challenge to a Federal Communications Commission rule that prohibits local franchising authorities from refusing to award competitive cable franchises.

In an order Monday, the high court denied the petition of the Alliance for Community Media, which wanted the high court to review a 2007 FCC order.

In June 2008, the U.S. Court of Appeals for the Sixth Circuit denied petitions to review the FCC's rule, which aims to open up competition in the cable franchising market. The...
