Nike Gets Default Win In TM Suit Over Counterfeit Shoes
Law360 (July 19, 2018, 6:26 PM EDT) -- A New Jersey federal judge handed a win Wednesday to Nike Inc. in a lawsuit against several shipping companies who helped transport thousands of counterfeit shoes from China to the United States.
U.S. District Judge Claire C. Cecchi granted Nike’s motions for summary judgment on its claims against two affiliate companies called City Ocean International Inc. and City Ocean Logistics Ltd., finding that whether they knew the shipments were counterfeit is not relevant to whether they can be held liable under the Lanham Act.
