Drummond Co. Loses Review Bid Over Ex-Miner's Benefits

Law360 (July 26, 2018, 4:39 PM EDT) -- The Eleventh Circuit has tossed a Drummond Co. Inc. bid to review a decision backing a benefits award given to a former company coal miner who had been diagnosed with a lung disease, rejecting the company's argument that the benefits claim wasn't timely.

A three-judge panel on Wednesday denied a petition for review of the U.S. Department of Labor's Benefits Review Board in the case, in which the company said Gary Cox's 2013 benefits claim came too late because he was notified "in 2004 or 2005 that he was totally disabled due to his pneumoconiosis."
