Insurer Owes $5M For Lyondell Cleanup Deal: Lubrizol

Law360, New York (June 17, 2009, 12:00 AM EDT) -- Lubrizol Corp. has asked a court to decide whether pollution at a Texas Superfund site is the result of one or five “occurrences,” a $5 million question in a dispute between the company and its reluctant insurer, Security Insurance Co. of Hartford.

Lubrizol wants a declaratory judgment that the pollution at Turtle Bayou Superfund site was the result of five occurrences, which will leave Security Insurance on the hook for $5 million, it said in a second amended counterclaim filed Wednesday in the U.S. District Court...
