FWS Finds Marbled Murrelet Still Imperiled Under ESA

Law360, New York (June 18, 2009, 12:00 AM EDT) -- The U.S. Fish and Wildlife Service has refused to declassify the marbled murrelet as a threatened species after a five-year review, in a blow to timber groups that petitioned to delist the seabird native to the Pacific Coast as protected by the Endangered Species Act.

On Wednesday, the FWS announced the completion of its five-year status review of the marbled murrelet, finding the ESA protects the populations on the Washington, Oregon and California coasts.
