Supreme Court Blocks Retrial For Ex-Enron Exec

Law360, New York (June 18, 2009, 12:00 AM EDT) -- The U.S. Supreme Court on Thursday further interpreted the reach of the double jeopardy clause of the Fifth Amendment, in a decision that blocks prosecutors from taking another shot at convicting a former Enron Corp. executive of insider trading and other fraud charges.

In a 6-3 decision, the high court ruled that prosecutors may not retry charges left undecided by a jury when the jury has also acquitted the defendant on other counts that were based on related factors.
