Trucking Co.'s Liability Capped In Drug Shipment Loss

Law360, New York (June 19, 2009, 12:00 AM EDT) -- A federal judge has ruled that trucking company KLLM Inc. is not required to pay either Watson Pharma Inc. or its property insurer Factory Mutual Insurance Co. about $710,000 for the loss of a truckload of pharmaceutical products.

Judge Daniel P. Jordan III of the U.S. District Court for the Southern District of Mississippi on Wednesday granted partial summary judgment to KLLM, concluding that a transport agreement Watson entered limited the carrier’s liability to $100,000 per shipment.
