NRG Suit Over Exelon's $6.2B Buyout Offer Tossed

Law360, New York (June 22, 2009, 12:00 AM EDT) -- A federal judge has tossed a lawsuit alleging Exelon Corp. lied to shareholders at power company NRG Energy Inc. to pressure board members at the reluctant merger target to agree to Exelon’s $6.2 billion acquisition proposal.

Judge John G. Koeltl of the U.S. District Court for the Southern District of New York dismissed the complaint Friday after testimony and evidence presented at a two-day bench trial failed to convince him that Exelon officials were acting with secret intentions.
