2nd Circ. Backs Clinic Workers In NLRB Picketing Spat

Law360, New York (June 23, 2009, 12:00 AM EDT) -- A federal appeals court has ruled that the National Labor Relations Board improperly construed the National Labor Relations Act in upholding a health care institution's firing of employees who participated in picketing that violated the act's 10-day notice requirement.

The U.S. Court of Appeals for the Second Circuit on Friday granted a petition for review from the Civil Service Employees Association, Local 1000; vacated the NLRB's decision and order; and remanded the case.
