Class Claims Nixed In Katrina Levee Breach Litigation

Law360, New York (June 24, 2009, 12:00 AM EDT) -- A judge has dismissed class action claims against a number of insurers that include Liberty Mutual Insurance Co. and State Farm in the consolidated levee breach litigation over Hurricane Katrina, saying individual issues predominate in the litigation.

In an order June 16, Judge Stanwood R. Duval Jr. of the U.S. District Court for the Eastern District of Louisiana struck the class allegations from a lawsuit alleging a slew of insurance companies breached their fiduciary duty, among other things, with regard to their handling of Katrina claims....
