Fed. Circ. Upholds Amazon's Alice Win In EveryMD Patent Suit

Law360 (September 10, 2018, 6:46 PM EDT) -- The Federal Circuit on Monday ruled an EveryMd.com LLC patent covering online communications was invalid under the U.S. Supreme Court’s Alice test, upholding a lower court ruling in favor of Amazon.com Inc.

The appeals court, in a summary order, affirmed a California federal judge’s December 2017 decision to dismiss EveryMD’s infringement lawsuit against Amazon because the patent covered nothing more than the abstract idea of exchanging messages through an intermediary.
