LED Bulb Case Shines Light On FTC Enforcement

Law360 (September 12, 2018, 3:12 PM EDT) -- A recent restitution announcement by the Federal Trade Commission, the final step in a long-standing enforcement action, provides important lessons for companies and their counsel involved in the formulation of advertising claims, particularly technical claims about products’ performance attributes.

The FTC announced at the end of August that it is mailing almost a half million checks, totaling more than $14.4 million, to consumers who previously purchased Lights of America brand light-emitting diode lightbulbs. (Those consumers who purchased bulbs but do not receive a check can apply for a refund.)
