Ky. Jury Finds Sandoz Liable For $16M In AWP Case

Law360, New York (June 25, 2009, 12:00 AM EDT) -- A Kentucky jury has found that Sandoz Inc., the generic drugs division of Novartis AG, should shell out $16 million for defrauding the state’s Medicaid program and consumers by artificially boosting the prices for prescription drugs.

Kentucky Attorney General Jack Conway said Wednesday a jury of the Franklin County Circuit Court handed down the verdict against Sandoz in the state’s case accusing dozens of companies of publishing inflated average wholesale prices for their drugs and causing the state's Medicaid program to overpay for medications.
