2 Risperdal Cases Greenlighted For Punitive Damages Trials

Law360 (September 18, 2018, 9:06 PM EDT) -- A Pennsylvania judge has cleared the way for two boys to seek punitive damages from a Johnson & Johnson unit on their claims that they weren't adequately warned about the risk of breast growth associated with the antipsychotic drug Risperdal.

Judge Arnold New in the Philadelphia County Court of Common Pleas on Friday rejected arguments that J&J subsidiary Janssen Pharmaceuticals Inc. should be allowed to rely on statutory protections against punitive damages offered under New Jersey law to avoid the prospect of additional payouts to the boys, who have already been awarded compensatory damages.
