Calif. Appeals Court Backs Insurers In Supervalu Suit

Law360, New York (June 26, 2009, 12:00 AM EDT) -- A California appeals court has upheld a ruling supporting Continental Casualty Co. and other insurers' interpretation of the word “occurrence” in a dispute with grocery wholesaler Supervalu Inc. related to excess workers' compensation policies.

In a decision published June 22, the Court of Appeal of the State of California, Second Appellate District, affirmed a trial court's ruling to grant summary adjudication in favor of Continental and TIG Insurance Co. and summary judgment to Wexler Underwriting Managers.
