Ala. Hospital Reaches $4.3M FCA Deal Over Toxicology Tests

Law360 (September 24, 2018, 7:06 PM EDT) -- East Alabama Medical Center and its subsidiary Aperian Laboratory Solutions LLC have agreed to pay $4.25 million to settle allegations that they violated the False Claims Act by paying kickbacks in exchange for toxicology lab test referrals, according to the whistleblower’s attorneys.

Leamon M. Fite III’s suit against EAMC and Aperian alleged that they paid commissions to marketing companies to arrange for the toxicology tests to be sent to Aperian, which violates the Anti-Kickback Statute, according to Hare Wynn Newell & Newton LLP.
