Jury Rejects BNSF Worker's $45M Exposure Claims

Law360, New York (June 29, 2009, 12:00 AM EDT) -- A Texas jury has reportedly sided with BNSF Railway Co. in a $45.4 million lawsuit filed by a man who claimed he developed cancer after years of exposure to toxic chemicals while working at one of the railroad company's plants.

The verdict by jurors in Burleson County, Texas, came after a nearly 10-week trial in which the plaintiff, 56-year-old Dennis Davis, alleged that BNSF misled workers at the railroad tie-manufacturing plant in Somerville while exposing them to carcinogenic chemicals, the Associated Press reported Thursday.
