7th Circ. Tosses Appeal Over Kerr-McGee Cleanup

Law360, New York (June 30, 2009, 12:00 AM EDT) -- A federal appeals court has dismissed an appeal by Lefton Iron & Metal Co. disputing how much it must pay oil company Kerr-McGee Chemical Corp. for the costs of cleaning up an industrial site, ruling that a lower court must first decide which party gets the benefits of proceeds covered by Kerr-McGee's insurers.
