Judge Refuses To Rethink Ruling In Toshiba IP Suit

Law360, New York (July 1, 2009, 12:00 AM EDT) -- A federal judge has refused to reconsider a decision subjecting Toshiba Corp.'s newly formed subsidiary with Samsung Electronics Co. to the terms of a patent licensing agreement with Discovision Associates.

Judge Harold Baer of the U.S. District Court for the Southern District of New York on Tuesday affirmed his May 18 ruling that Toshiba's agreement to pay DVA royalties on sales of certain digital recording devices extends to subsidiary Toshiba Samsung Storage Technology Corp.

Judge Baer has not ruled on whether Toshiba owes DVA additional royalties...
