Insurer Must Defend School In Frat Death Suit: Judge

Law360, New York (July 1, 2009, 12:00 AM EDT) -- Landmark American Insurance Co. has a duty to defend Rider University in a lawsuit alleging that a student at the school died from acute alcohol poisoning after attending a 2007 on-campus fraternity pledging event, a federal judge has ruled.

District Judge Freda Wolfson on Tuesday ruled in the U.S. District Court for the District of New Jersey that Landmark has a duty to defend Rider as an additional insured on an insurance policy held by Phi Kappa Tau fraternity, although it does not owe a similar...
