Versata Antitrust Claims Trimmed In Sun Patent Suit

Law360, New York (July 6, 2009, 12:00 AM EDT) -- In a patent dispute brought by Sun Microsystems Inc. against Versata Inc., a federal judge has nixed two of Versata's antitrust counterclaims but preserved most of its other nonpatent allegations, including unfair competition.

Judge Joseph J. Farnan Jr. of the U.S. District Court for the District of Delaware on Wednesday dismissed without prejudice Versata's counterclaims of sham litigation and Walker Process fraud, but left unfair competition, intentional misrepresentation and concealment, and negligent misrepresentation allegations intact.
