Ex-Softchoice Worker Trade Secrets Case Dismissed

Law360, New York (July 7, 2009, 12:00 AM EDT) -- A judge has dismissed a lawsuit brought by Softchoice Corp. accusing a former employee of stealing trade secrets when he left the computer software and hardware reseller to go work for a rival.

Judge Joseph F. Bataillon of the U.S. District Court for the District of Nebraska threw out the case against Brett MacKenzie in an order Thursday, saying the former sales representative had produced evidence showing that the information in question is freely available throughout the industry.
