DC Circ. Won't Curb Discovery In Shepherds' H-2A Visa Suit

Law360 (November 7, 2018, 6:32 PM EST) -- The D.C. Circuit on Wednesday refused to curb discovery in a lawsuit brought by a group of foreign sheepherders challenging the federal government’s practice of handing out temporary work visas for longer-term labor.

In a one-line order without an opinion, the appeals court denied the government’s bid for a limited rehearing of an August panel decision, which had revived parts of the shepherds’ lawsuit against the government’s H-2A visa rules and remanded the case back to the district court to resolve those revived claims.
