MTC Urges Supreme Court To Take Ala. Railroad Tax Case

Law360 (November 9, 2018, 7:43 PM EST) -- The Multistate Tax Commission on Friday urged the U.S. Supreme Court to resolve a more than decadelong dispute between a transportation company and the Alabama Department of Revenue by taking a case involving an exemption for water carriers from sales and use tax on fuel.

The commission asked the high court in its amicus brief to take the case, one it has heard twice before, involving potential differential tax treatment for CSX Transportation Inc. It stressed that while railroad companies can bring a wide range of claims against states, few guidelines exist on how those claims should be resolved.
