DC Circ. Denies Review Of FERC Refund Order

Law360, New York (July 7, 2009, 12:00 AM EDT) -- A federal appeals court has ruled that the Federal Energy Regulatory Commission acted appropriately in awarding a partial refund to power generators for the cost of connecting to public utility lines, rejecting bids for review by both generators and utility companies, which disputed the decision.

The U.S. Court of Appeals for the District of Columbia Circuit on Tuesday denied petitions for review submitted by power generators on the grounds that FERC acted reasonably and dismissing petitions from public utility companies for lack of standing.
