Bounty Bar Shape Can't Be Trademarked: EU Court

Law360, New York (July 8, 2009, 12:00 AM EDT) -- A European court ruled Wednesday that the shape of the coconut-filled Bounty candy bar made by Mars Inc. is not distinctive enough to register as a trademark.

The Court of First Instance upheld a decision by the Office of Harmonization for the Internal Market, which controls trademarks in the European Union, to invalidate the trademark Mars had been issued on the shape of the candy.

The ruling was a victory for German chocolate maker Ludwig Schokolade, which had challenged the trademark.
