ThermoLife Accuses Supplement Co. Of False Advertising

Law360 (November 26, 2018, 9:32 PM EST) -- Dietary supplement maker ThermoLife International LLC has accused rival American Fitness Wholesalers LLC of unfair competition and false advertising, according to a suit entered in Arizona federal court Monday, alleging the company has been improperly labeling its products as containing "patented creatine nitrate."

In its Nov. 21 complaint, ThermoLife said it holds 23 patents for its development and use of ingredients in its dietary supplements and food products — 14 of which are related to the use of amino acids combined with nitrates to "increase athletic performance" — which the company said American Fitness is falsely advertising on its own supplements....
