US Docs Kept Back In ObTape Discovery Dispute

Law360, New York (July 10, 2009, 12:00 AM EDT) -- Plaintiffs in the multidistrict product liability litigation over Mentor Corp.'s ObTape will gain access to unredacted reports of problems from foreign doctors, but they will not be able to peek at files by U.S. doctors, a federal judge ruled Friday.

The U.S. Food and Drug Administration has a legitimate policy interest in protecting the names of American doctors who report problems with medical devices, but that does not apply to doctors overseas, Judge Clay Land of the U.S. District Court for the Middle District of Georgia...
