High Court Rejects Northwest Bid For Appeal

Law360 (October 2, 2006, 12:00 AM EDT) -- The U.S. Supreme Court refused on Monday to allow Northwest Airlines Inc. to file an appeal in a long-simmering predatory pricing dispute with Spirit Airlines Inc., because an attorney for Northwest missed a filing deadline.

Lawyer Roy Englert Jr., a partner at Robbins Russell Englert Orseck & Untereiner LLP, missed the writ of certiorari deadline by five days. Following the Supreme Court’s decision to not hear the case, the dispute will now proceed at the lower court, where a trial has not yet been held....
