Law360 (December 18, 2018, 6:46 PM EST) -- A coalition of environmental groups on Monday asked a New York state judge to strike down a state program offering subsidies to prop up struggling nuclear power plants, arguing that the state's Public Service Commission violated the requirements for public comment and review.
The groups, led by Hudson River Sloop Clearwater, said the PSC illegally changed a clean energy plan at the last minute in the summer of 2016 to include $7.6 billion in ratepayer subsidies for nuclear plants. The groups said the provision, which also created zero-emission credits, improperly hinged on Constellation Energy Nuclear Group LLC and Exelon Generation Co....
