Ariz. Nurses Win Class Cert. In Wage Antitrust Case

Law360, New York (July 15, 2009, 12:00 AM EDT) -- A group of nurses has won class certification in a suit accusing an Arizona health care association and some member hospitals of operating an anti-competitive cartel to drive down nurses' wages.

Judge Susan R. Bolton of the U.S. District Court for the District of Arizona on Tuesday certified the case's per diem nurses as a class, but she declined to certify a class of their traveling counterparts, saying that their often individually negotiated wages and varying circumstances mean individual issues predominate.
