Keep Antitrust Suit Against Caterpillar, Equipment Co. Says

Law360 (January 16, 2019, 4:34 PM EST) -- International Construction Products LLC urged a Delaware federal court Tuesday not to toss its suit accusing Caterpillar Inc. and other manufacturers of keeping it out of the construction equipment market, saying it provided the court with enough evidence of antitrust violations.

After lower-priced imported construction equipment became more prevalent, and sellers including ICP began to sell equipment online at sites like IronPlanet, the manufacturers conspired to keep ICP from selling construction equipment directly to end users, ICP said.
