Claims Survive In Citrucel Suit

Law360, New York (July 20, 2009, 6:10 PM EDT) -- A federal judge has refused to dismiss a slew of claims against flavoring chemical manufacturer Siratsa LLC in a lawsuit stemming from the 2006 recall of GlaxoSmithKline's Citrucel, finding that a distributor agreement Siratsa claimed cleared it from liability could not be considered by the court.

The ruling, handed down Friday in the U.S. District Court for the Eastern District of Missouri, denied defendant Siratsa's motion to dismiss GSK's claims. It also denied Siratsa and affiliates FMC Corp. and Solutia Inc.’s motion to dismiss third-party plaintiff...
