Ex-CEO Asks 2nd Circ. For Bail During Valeant Fraud Appeal

Law360, New York (January 25, 2019, 10:38 PM EST) -- The former CEO of mail-order pharmacy Philidor Rx Services LLC on Friday asked the Second Circuit to keep him out of prison while he appeals his conviction for running a purported $9.7 million kickback scheme with a former Valeant Pharmaceuticals International Inc. executive, deeming the bribery charges defective.

Ex-Philidor head Andrew Davenport and former Valeant executive Gary Tanner were in October each sentenced to a year and a day in prison, following their convictions at trial of honest services wire fraud and conspiracy. They are due to report to prison on Jan. 31.
