Judge Rules For Abbott In Depakote Patent Suit Vs. Apotex Unit

Law360, New York (March 16, 2004, 12:00 AM EST) -- A judge with the U.S. District Court for the Northern District of Illinois has ruled that TorPharm's generic product infringes on Abbott Laboratories’ patents for the epilepsy and mania treatment Depakote.

In his opinion, Judge Richard A. Posner found that Abbott has proved that TorPharm's product infringes Abbott's patents for Depakote.

TorPharm is a unit of Apotex, the largest Canadian-owned pharmaceutical company.

The U.S. Court of Appeals had previously upheld the validity of Abbott's patents.
