Case Over Lilly's Zyprexa Gets Booted For 2nd Time

Law360, New York (July 22, 2009, 7:20 PM EDT) -- A judge has reconsidered a summary judgment ruling in favor of Eli Lilly & Co. and dismissed for a second time a wrongful death case alleging the company failed to warn doctors and consumers about possible harmful effects of the drug Zyprexa.

Judge Jack B. Weinstein issued the ruling Tuesday in the U.S. District Court for the Eastern District of New York in the case filed by the estate of Donna L. Smith, which has been consolidated into multidistrict litigation over the physicatric drug.
