9th Circ. Backs Valdez Damages Plan

Law360, New York (July 24, 2009, 1:19 PM EDT) -- Sea Hawk Seafoods Inc. has failed to recast the allocation of Exxon Mobil Corp.’s damages for the Valdez oil spill, as an appeals court concluded that the $507.5 million punitive damages award was fairly apportioned among the plaintiffs.

On Thursday, Judges Mary Schroeder, Andrew Kleinfeld and Sidney Thomas of the U.S. Court of Appeals for the Ninth Circuit rejected the seafood processor’s appeal, affirming the lower court’s view that the plaintiffs needn’t receive the same amount of punitive damages as they did compensatory damages.
