Unum Beats Baker Donelson Atty's Disability Benefits Suit
Law360 (February 22, 2019, 8:20 PM EST) -- Unum Life Insurance Co. of America won't have to face a lawsuit claiming it wrongly denied a Baker Donelson Bearman Caldwell & Berkowitz PC attorney long-term disability benefits after a Louisiana federal judge ruled the insurer reasonably concluded she wasn't unable to work because of fibromyalgia.
U.S. District Judge Martin L.C. Feldman granted Unum summary judgment in an order Thursday, finding that litigator Anne Wittmann hadn't shown that Unum's denial of benefits was arbitrary or capricious and rejecting her assertion that the insurer's decision clashed with the evidence, Employee Retirement Income Security Act claim-handling procedures, and its own internal guidelines....
