Crawfish Buyers Seek Class Cert. In Bayer Action

Law360, New York (July 28, 2009, 5:03 PM EDT) -- A group of crawfish buyers and processors has moved for class certification in a suit accusing a Bayer AG unit of selling pesticide that decimated the Louisiana crawfish population.

In a motion for class certification filed Monday with the U.S. District Court for the Western District of Louisiana, the plaintiffs allege that Bayer CropScience LP violated the Louisiana Products Liability Act through inadequate warnings and untrue express warranties about the safety of the pesticide Icon, designed to control rice water weevil damage.
