Fair Use Defense Killed In Sony File-Sharing Spat

Law360, New York (July 28, 2009, 4:27 PM EDT) -- The judge in charge of a consolidated group of file-sharing cases brought by record labels including Sony BMG Music Entertainment has rejected one music downloader's fair use defense, contending it would “swallow the copyright protections” created by Congress.

In an electronic order on Monday, Judge Nancy Gertner of the U.S. District Court for the District of Massachusetts granted summary judgment to the record label plaintiffs on the issue of fair use.
