Venue Ruling Invites Forum Shopping, Pa. Appeals Court Told

Law360 (March 6, 2019, 7:34 PM EST) -- A trio of defense-focused advocacy groups warned the Pennsylvania Superior Court that allowing out-of-state companies to face lawsuits in Pennsylvania simply because they are registered to do business there would open it to an unprecedented wave of forum shopping.

The warning, submitted Monday, comes as an en banc Pennsylvania Superior Court prepares to weigh in on a case over whether Illinois-based Federal Signal Corp. — despite having a minimal presence in the state — could face claims from a group of firefighters from New York and Massachusetts over hearing loss from their exposure to sirens.
