Appeals Court Reverses Decision Over Union Button

Law360, New York (October 6, 2006, 12:00 AM EDT) -- A federal appeals court Thursday overruled a lower court decision that a hospital violated an employee’s First Amendment rights by not letting him wear a “Union Yes” button on his work uniform.

The U.S. Court of Appeals for the Fifth Circuit decided that the hospital’s interest in promoting the efficiency of its public service outweighed the employee’s interest.
