Appeals Court Reinstates Case Over Diabetes Drug

Law360, New York (October 6, 2006, 12:00 AM EDT) -- A federal appeals court reinstated a case Thursday brought by several Michigan residents who say they were hurt from taking the diabetes drug, Rezulin, which was yanked from the market in 2000.

The U.S. Court of Appeals for the Second Circuit said that the case could proceed in spite of a Michigan state law that shields pharmaceutical companies from product liability claims unless there is evidence that the drug company misrepresented or withheld material information to gain FDA approval for a drug.
