Hartford Faces Class Action Over Hurricane Wilma

Law360, New York (July 29, 2009, 4:06 PM EDT) -- Homeowners have lodged a proposed class action against Hartford Insurance Co. of the Midwest alleging the insurer refused to pay claims from Hurricane Wilma until the homeowners replaced property, which is a violation of Florida law.

In a suit filed Tuesday in the Broward County Circuit Court of Florida, Irwin and Claudia Mounsey and Fred and Muriel Godfrey said the actions of Hartford violated a state law that requires insurers to pay the replacement cost of policies with replacement cost coverage, irrespective of whether the policyholder...
