J&J Talc Supplier Tort Claimants Fight Insurance Fund Bid

Law360 (March 19, 2019, 10:35 PM EDT) -- The official committee of tort claimants in Johnson & Johnson talc supplier Imerys Talc America Inc.'s Chapter 11 told the Delaware bankruptcy court Tuesday that Imerys' former owners aren't entitled to access insurance proceeds.

The committee, recently set up to represent those who have tort claims against Imerys' estate, asserts that the supplier's former owners Cyprus Mines Corp. and Cyprus Amax Minerals Co. have not shown they have a right to access the insurance proceeds as a dispute rages on in Imerys' Chapter 11 over ownership of the policies, or that Cyprus' interest in the funds needs to be adequately protected....
