9th Circ. Nixes Tata Bid To Send Worker Suit To India

Law360, New York (August 3, 2009, 11:20 AM EDT) -- A federal appeals court has upheld a lower court's denial of a bid by India's largest business group to dismiss a putative class action by employees alleging unjust enrichment and allow the dispute to be arbitrated in India.

The U.S. Court of Appeals for the Ninth Circuit on Thursday denied the request by Tata America International Corp. and its parent corporations Tata Consultancy Services Ltd. and Tata Sons Ltd., affirming a decision by the U.S. District Court for the Northern District of California.
