Daiichi Earns Win Against Mylan Over Benicar Patent

Law360, New York (August 4, 2009, 4:38 PM EDT) -- A federal judge has ruled that Mylan Pharmaceuticals Inc. infringed Daiichi Sankyo Co. Ltd.'s patent for the active ingredient in Benicar when Mylan tried to market a generic version of the hypertension drug.

Judge William J. Martini of the U.S. District Court for the District of New Jersey handed down his opinion Thursday after a two-week trial, ruling that Mylan could not clearly prove that the patent was invalid because of obviousness.
